BUSINESS PARTNERS PRIVACY NOTICE

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)

This privacy statement informs you how and for what purposes your personal data will be processed and will explain your rights under applicable data protection law. In order to protect the integrity and security of personal data, modern, professional standards will be applied.

I

Korea Fuel Tech Poland (hereinafter referred to as the „Company”) is the administrator of personal data that you provide to us in connection with business relationships that have been created between you as a data subject and the Company, or in connection with business relationships that have arisen between the Company and the entity on behalf of and for the benefit of which you represent, which is necessary to take action before establishing a business relationship in accordance with your request, or the entity’s request, on behalf of and for whom you represent (hereinafter referred to as „business relationships”).

Unless agreed otherwise, the Company will only process personal data required in connection with our business relationships. This includes your contact details, in particular your name, surname, subject name, on behalf of and for whom you are acting, your position, address, telephone number, e-mail address, other contact details, your signature and business details, type and the number of the document confirming the authorization to conduct business and entry in the relevant register, including data contained therein, account number and appropriate amount, as well as data necessary to protect the Company’s rights, in particular data regarding your financial credibility; receivables and liabilities expected or incurred in connection with the exercise of business.

Your personal data is collected directly from you, in particular when establishing business contacts, by participating in the company’s selection of contractors procedure, by accepting an order, by submitting an offer for possible future transactions to the Company, or in another way. We do not obtain personal data from third parties. We do not take any automatic decisions regarding you, nor do we create any profiles using your personal information.

We use your personal data only for the purpose of: negotiating and concluding business relationships, commercial communication, implementation of all obligations arising from trade relations, as well as their solutions, fulfillment of legal obligations, especially regarding taxes and duties, and protection of the Company’s legitimate interests, in particular in the scope of applying the right to defects, claims, or to protect the rights of the Company.

The legal basis for the processing of personal data in the context of economic relations may be, in particular, the performance of the contract in accordance with Article 6 par. 1 point b) RODO, or personal data processing in the legitimate interest of the Company in accordance with art. 6 par. 1 point f) RODO, for example in connection with the processing and storage of contact details of the entity, or processing necessary to fulfill the legal obligations of the Company, for example in the field of taxes and duties, in accordance with art. 6 pairs 1 point d) RODO. Failure to provide the Company with necessary personal data may result in hindering or preventing business communication or ensuring business relationships.

We store and process personal data within the European Economic Area. As part of the Company’s business activities, we may also transfer personal data to recipients in countries outside the European Economic Area („third countries”), in which the applicable provisions do not provide the same level of data protection as the provisions of the law of the Republic of Poland. In so doing, we will comply with applicable data protection requirements and take appropriate safeguards to ensure the security and integrity of personal data.

We may transfer personal data to service providers (such as cloud service providers) in the Republic of Poland, or abroad, for the purpose of processing personal data on behalf of the Company and in accordance with our instructions. In this case, we will retain control of your personal information.

We may share personal data with affiliates if it complies with the law, in a specific scope. In such cases, these entities will use personal data for the same purposes and under the same conditions as described in this document.

Your personal data may be shared with third parties if we sell or buy any company or asset, in which case we may disclose personal information to a potential seller or buyer of such business or assets, along with professional advisers. If the Company or substantially all of its assets are acquired by a third party, the personal data about business partners in the Company’s possession will be one of its transferred assets.

Otherwise, no third party will have access to your personal information unless it is a legal obligation or you give us permission to do so.

We store your personal data only for the necessary period of time, in particular throughout the period of business relations, for at least 10 years from the end of the year in which the cooperation was completed. We will also store your personal information for as long as it is necessary to defend or enforce the Company’s legal claims, or until the claim is settled. If your personal information is contained in documents necessary for tax and / or customs purposes or for other purposes which are subject to public authority control, your data will be stored for possible public authorities’ inspection in accordance with the applicable law.

You have the right to request that we access your personal data as well as correct or delete them, as well as limit the processing of personal data and opposition to processing, as well as the right to transfer data in accordance with the general EU data protection regulation. In particular, you have the right to request a copy of the personal information we hold about you. If you use this service many times, we can charge you for it. If you would like to transfer your personal information to another controller, we will provide you with the personal information you have provided to us and which has been processed in a portable format that can be read for free. We want to make sure that your personal information is accurate and up-to-date, or you can ask us to correct or delete any information that you think is inaccurate.

For any of the above requests, please send a clear description of your requirements, including personal data, and provide your name, contact details and date of birth as an identity card to the e-mail address provided below. We may require additional identity card to protect your personal data from unauthorized access.
